Terms of Service

These terms describe what you can expect from OpaqueShare and what we expect from you. By creating an account or using the service, you agree to them. If you don't, please don't use the service.

1. Who you're contracting with

"OpaqueShare," "we," "us," and "our" refer to Zihne ([PLACEHOLDER: registered company name, Companies House number, and registered UK address]). "You" means the individual accepting these terms, or the entity that person represents.

2. The service

OpaqueShare is a file transfer application. Files are encrypted on your device before upload; we store ciphertext and route it to the recipient you designate. Transfers auto-delete after download or after a fixed period (currently 7 days) if no download occurs.

Some features are free within a monthly allowance; larger volumes require a paid subscription or prepaid credit pack, purchased through Google Play Billing.

4. Acceptable use

OpaqueShare's zero-knowledge architecture means we can't see your files. That doesn't grant you a right to use the service for illegal purposes. In particular, you agree not to use OpaqueShare to send, store, or facilitate:

Reports of abuse can be sent to contact@zihne.com. We cooperate with law-enforcement requests to the extent required by UK law, but the zero-knowledge design means the operational data we can supply is limited (we cannot decrypt what we don't have the keys to).

6. Availability and changes to the service

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, and force majeure events may cause downtime. We may add, modify, or remove features. Material changes affecting features you paid for will be communicated with reasonable notice.

The service is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any other liability that cannot be excluded under applicable law.

9. Limitation of liability

Subject to section 8, our total liability arising from your use of OpaqueShare in any 12-month period is limited to the amount you paid us for the service during that period, or £100, whichever is greater.

We are not liable for indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or business interruption, except to the extent this exclusion is prohibited by law.

10. Intellectual property

You retain all rights to the files you upload. By using OpaqueShare you grant us a narrow, temporary licence to store, transmit, and route those files to the recipients you designate — solely to provide the service. This licence ends when the transfer is deleted (typically within 7 days of upload).

The OpaqueShare name, logo, source code, and documentation are protected by intellectual property law. Public parts of the code base are licensed separately as noted in their repositories.

11. Changes to these terms

We'll update these terms occasionally. Material changes will be communicated in-app or by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.

12. Governing law and disputes

These terms are governed by the laws of England and Wales. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you're a consumer resident in the European Union or elsewhere, you retain the protection of the mandatory consumer laws of your country of residence.
